La solidaridad cambiaria en relación con el fenómeno prescriptivo

dc.description.abstract | La solidaridad cambiaría es el efecto jurídico que en nuestra legislación se predica de los suscriptores de un título valor en un mismo grado al tenor de lo normado en el artículo 632 del Código de Comercio. Ahora bien, el legítimo tenedor del título puede hacerlo valer contra los suscriptores que se obligaron (Art. 785 C.Cio.); a su vez el artículo 825 del Código de Comercio reza que “En los negocios mercantiles, cuando fueren varios los deudores se presumirá que se han obligado solidariamente.” Esta solidaridad cambiaría toma un matiz interesante cuando se enmarca dentro del fenómeno prescriptivo que sobreviene a la acción cambiaría de los títulos valores por el hecho de no ejercitarla dentro del tiempo señalado en los artículo 730 y 789 del Código de Comercio según fuere el caso y en relación con lo normado en el artículo 792 del Código de Comercio, que dice: “Las causas que interrumpen la prescripción respecto de uno de los deudores cambiarios no la interrumpen respecto de los otros, salvo el caso de los signatarios en un mismo grado.” (El subrayado es nuestro). Ahora bien, si contrastamos las anteriores disposiciones sustanciales dentro del entorno del proceso ejecutivo, cobra especial relevancia el artículo 90 del C.P.C., y su efecto sobre la interrupción de términos de prescripción como consecuencia de la presentación de la demanda y su notificación a la vez que el artículo 306 del C.P.C., y el Art. 2513 del C.C., los cuales mencionan que la prescripción no puede ser declarada de oficio por el juzgador y que debe ser alegada por quien pretenda aprovecharla. | spa |
