dc.description.abstract | Desde el punto de vista del derecho penal sustancial, el Estado aparece investido del derecho de sancionar a quienes infringen las normas penales. Es un derecho material el derecho de castigar; que el Estado ejerce de manera exclusiva y sín posibilidad de renuncia. Cuando una persona natural realiza un comportamiento típico, antijurídico y culpable, se constituye la relación pública de derecho sustancial entre el Estado como Sujeto activo del ius puniendi y el autor del hecho punible, como sujeto pasivo, obligado a afrontar el proceso y a aceptar la pena legalmente establecida e impuesta. | spa |
