dc.description.abstractEl estado, según la ideología liberal, solo tendría funciones negativas, de mero árbitro o gendarme del juego social. Debería dejar hacer sin interferir en las relaciones sociales ni económicas. O mejor dicho, tomar las iniciativas necesarias para garantizar exclusivamente la plena realización de las leyes "naturales" del orden social y del mercado que se organizaría en virtud de una “mano invisible” -- según la conocida imagen de Adam Smith. Las funciones del derecho, en este sentido, se concebían desde una perspectiva meramente negativa, como funciones de vigilancia y control encaminadas a mantener los fundamentos del orden social (Calvo García 2002: 60-61).spa

dc.description.abstractenglishThe state, according to liberal ideology, would only have negative functions, of mere referee or gendarme of the social game. It should be done without interfering with social or economic relations. Or rather, take the necessary initiatives to exclusively guarantee the full realization of the "natural" laws of the social and market order that would be organized by virtue of an "invisible hand" - according to the well-known image of Adam Smith. The functions of law, in this sense, they were conceived from a merely negative perspective, as surveillance and control functions aimed at maintaining the fundamentals of the social order (Calvo García 2002: 60-61).eng
